Population Pressure: Shall India Revamp its Citizenship Rules?

In the recent past, the leader of a political party of Muslims in India, Asaduddin Owaisi has asked for Muslim Quota in different spheres of the Indian society. His demand was thought-provoking. What if Indian citizenship is made conditional, based on the existing provisions of the Constitution?

PART I:

In the recent past, AIMIM leader Asaduddin Owaisi has asked for separate 'Muslim Quota' in India. This implies, Muslims aren't perhaps satisfied by managing to occupy a separate country (Pakistan) for them by dividing India on the basis of religion. Hence, now they perhaps wish to cut another slice from our land in the name of Muslim Quota.

This indeed provoked a few thoughts:
🔴How could Mr. Owaisi so candidly claim something that subtly hints at endangering our National Integration?
🔴Aren't Indian Muslims happy being Indian citizens?
🔴Why do they always tend to ask for special favour?
🔴Why does it often appear from some of their words & activities as if they want every Indian to abide by Islamic rule?

The answers that knocked my mind were that many of our Muslim citizens don't perhaps value Indian citizenship much & take it for granted, because we implement the rules of our Constitution only partially. Therefore, what if, remaining within the Constitutional provisions, the citizenship rules of India are made a bit dynamic to tackle all such divisive forces?

How? Before explaining on that, let us first have a look at some of the Articles of our Constitution.

PART II:

Please note or recall that Articles 5 to Article 10 of The Constitution of India elaborate on the rights & pre-conditions of citizenship of India. However, Article 11 of The Constitution of India, clearly states that 👇

"Nothing in the foregoing provisions (i.e. the provisions as per Article 5 to Article 10) of this Part shall derogate from the power of Parliament to make any provision with respect to the acquisition and termination of citizenship and all other matters relating to citizenship."

This means, The Constitution of India has kept provision for the Parliament to revisit the rules of citizenship anytime, if needed. This also extends to mean that the Parliament can terminate citizenship of persons based on antecedents or other relevant factors.

Again, please note or recall that Article 25 of The Constitution of India, Clause(1) has clearly stated,👇

🔴"Subject to public order, morality and health and to the other provisions of this Part, all persons are equally entitled to freedom of conscience and free profession, practice & propagation of religion."

Similarly, Article 26 of The Constitution of India has stated that,👇

 đŸ”´"Subject to public order, morality and health every religious denomination or any section thereof shall have the right to manage religious affairs."

It is also mentioned under clause (2) of Article 25 that 👇

🔴"Nothing in this article shall affect the operation of any existing law or prevent the State from making any law --
a) regulating or restricting any economic, financial, political or other secular activity which may be associated with religious practice;"

All these Articles of The Constitution of India, if regressed, mean that everyone in India can practice his religion & has full freedom to do that, without hampering public order, morality & health issues! This actually means that one is free to practice religion until & unless it negatively affects more important factors like public order, morality & health issues of all. Regression of all these Articles of The Constitution of India also unveils the fact that freedom to practice & manage religious affairs is not over & above the economic & financial priorities of the country.

PART III:

Based on these observations, some revisions of citizenship rules of India may be suggested.

🔴In the current context, the citizenship of any citizen of India, having proven connection with terrorists, or offering shelter to terrorists and not reporting to the State's Law n Order Department about it, may be terminated in order to maintain public order.

🔴So called religious malpractices like Triple Talaq, Nikah Halala, Child marriage etc must be made null n void on the basis of morality as The Constitution of India has placed public order, morality & health above religious practices. And anybody practicing such malice in the name of religion should be excluded of his / her citizenship rights of India.

🔴At present, Indian land has already amassed a load of 130 crore population. And hence, for economic & financial priorities as prescribed by The Constitution of India, India may try to control its population to control its economy better & for better health assurance of the newborn & future citizens of India.

🔴The people who are giving birth to too many children, must be made conscious about the fact that the economy of the country is lagging behind due to huge population pressure. And every person of reproductive age must be certified by the state so as to determine the maximum allowable number of children he/she may give birth to.

🔴If anyone fail to realise that, his/her citizenship right along with the Citizenship rights of his/her children may be written off for the sake of economic, financial & health improvements of the country.

🔴In spite of the number of women being lesser than per 1000 men in India, the men who would indulge in simultaneous multiple marriage, may be excluded of his citizenship right. All his wives too should be barred from having Citizenship rights. This is in order to control undue population-outburst.

If any individual man or woman indulge into having more than the maximum allowable number of children scheduled for him based on multi-factor evaluation by the State, he/she along with all the children may be made to lose their Citizenship rights.

If citizenship rules of India are revisited likewise, a huge reform may be worked out at the social level. Consciousness can be raised by strong & dynamic Citizenship laws for effective population control. The people, who'd tend to lose Citizenship on some grounds, may be made deprived of Governmental subsidies, reservations and other benefits thereof and/or may be made to pay huge amount of penalty.

India needs strong & dynamic laws to be scripted afresh for effective population control as well as to tackle divisive forces.
