Love Jihad: A Suggestion for Legal Prevention
Noting the increasing trend of inter-religious marital & conjugal relations in India, it's high time that we demand a suitable law from our Parliament to prevent such heinous crimes & pathetic incidents in the name of pious terms like LOVE & MARRIAGE.
When a Hindu girl marries or gets forced by her situation to marry a Muslim boy & adopts Islam, then the Hindu society loses one of its valuable member, thus slowly changing the demography of our land as the girl in future gives birth to children who, by default, assume their father's religion.
The reverse is very rare. We hardly hear about incidents where Hindu boys marry Muslim girls. And in such cases, if any, which are utterly few in number indeed, the Hindu boys are often heckled badly, sometimes even slain if can't be converted forcefully.
Since I'm describing the reality, it might not appear comfortable, as truth is often far from being comfortable.
Hence, even if 'Love Jihad' sounds awkward & even if there remains no mal-intention of expansionism by many Muslim boys behind their marrying Hindu girls (as doubted by many), such inter-religious marriages are, in fact, resulting in very slow & steady reduction of the number of Hindus.
Hindus, therefore, as a process of natural defence, must be careful to protect their religious cult and the demography of the land. This should be done by the Hindus for achieving natural justice towards themselves to survive as a religious cult. Every culture, every religious outlook & every philosophy of life has the natural right to protect itself from being engulfed by others & continue to exist on earth as it is. This is in conformity & also endorsed by the basic principles of The Constitution of India.
Moreover, noting the kind of atrocities that often results from such inter-religious relationships, some legal steps must be taken to check & prevent such untoward incidents. Suitable changes may be made in the Special Marriage Act suggestions on which are given hereafter.
Keeping in mind that no one can stop a young adult boy or a girl to fall in love with one another and / or marry each other, our Parliament may think of legally banning:
1. post-marital religious conversion
2. marriage of converted individuals to a person of such converted religion
3. Parliament may also declare the children born out of such inter-religious couples to have the Mother's religion by default instead of the father's. The Hindu society would have to accept such children as its own children. Law should arrange for special provisions for children born out of inter-religious marriages under Special Marriage Act. It should apply to the children of even a Muslim girl who marries a Hindu boy. Children of such a couple should be Muslims by default. We'll have to remember that this law would have the sole prerogative to prevent religious expansionism through marriage which is a bitter reality in the sub-continent. Our objective should be to fix the demographic proportion of India where it was at the time of independence.
If post-marital religious conversion is banned, then both the spouses would have to continue to stay in their own corresponding religious cult even after marriage & hence it would be no loss for either community.
Adopting any religion by choice is fully agreeable. But in that case, may we call India a SECULAR country? Complete religious freedom of all is a trait of Hinduism. Therefore, if India allows everyone to convert to a religion of his/her choice, then India undoubtedly becomes a Hindu Rashtra & not a SECULAR one. How religion is at all important in a SECULAR country may also arise as a relevant question in this regard. Whether any Indian may be allowed to adopt any religion later in his/her life changing from his/her original one while still remaining an Indian, may also be a matter of debate as India is a SECULAR country as per the preamble of our Constitution.
Moreover, conversion to any religion with vested interest of expansionism is just contrary to the idea of 'religion' itself because Indian philosophy never believed in religious or ideological aggression on one another. Rather, it always preached & prescribed peaceful co-existence of all. Therefore, in case of all inter-religious marriages, it becomes the moral responsibility of both the spouses to remain loyal to their original religio-cultural outlook & tradition throughout their lives. Since they opted for inter-religious marriage, it should become invariably mandatory for them to stick to their original religious identity.
If marriage of converted individuals to a person of such converted religion is made illegal, then no one can purposely undergo a pre-marital conversion in order to marry a pre-negotiated person of the same religion. Neither a Hindu girl can convert to Islam just in order to marry a Muslim boy nor the reverse. If anyone undergoes a religious conversion, he / she won't be able to marry a person of the same religion he / she is converting to.
This type of legal prohibition would not prevent the genuine lovers to marry each other for love but would definitely retard the evil attempts of those who tend to misuse the opportunities of love & marriage just for personal enjoyment and/or religious expansionism.
Declaring the children of such inter-religious couples to assume the mother's religion by default would retard those Muslims men, if any, who are alleged to marry Hindu girls for expansionism because in that case the children born out of a Hindu mother, would automatically be Hindus by such a law & reproductive expansion won't be possible.
This law would be an acid test to prove the genuineness of love of a couple for easy differentiation between genuine love birds & Love Jihadis,(if any).
It's high time that our Parliament drafts such intelligent, dynamic & modern laws in congruence with changing demands of time which would not only punish the criminals but also prevent crimes though such a law would challenge the patriarchal rule of the society that children adopts father's identity. Our Parliament has to decide which one to uphold higher, patriarchal rule or demographic balance.
